MEETING MINUTES
JUNE 9, 2021

Chairman Seyler called the monthly meeting for June to order at 7:00 pm at the Union Office at 500 Main St. The Open Meeting Laws were displayed for public reference.  On roll call:  Seyler – Aye, Vidlak – Aye, Crook – Aye and Ruby – Aye, Hill - Aye. Dave Chipman, Village Attorney, and Heather Cook, witness, also in attendance.

Minutes of the May Board Meeting were reviewed. Ruby motioned to approve May Meeting Minutes.  2nd by Crook.   By Roll, Trustee votes are as follows:  Seyler – Aye, Vidlak – Aye, Crook – Aye, Ruby – Aye, Hill -Aye. Motioned approved.

Claims and Accounts were presented. Ruby motioned to approve June Claims and Accounts.  2nd by Vidlak.  By Roll, Trustee votes are as follows:  Seyler – Aye, Vidlak – Aye, Crook – Aye, but abstained from approving his pay, Ruby – Aye, Hill - Aye.  Motion Approved.

CORRESPONDENCE- Clerk received estimate for park tree trimming, Heyen wants to trim them himself. The clerk received a quote for asphalt work in the amount of $19,685, and a map to include all marked projects, including 1st Street to Larue St. which is on our 1 & 6 year Street projects.  Also, received was a notice of Open House at the Plattsmouth Community Center on June 17th from NDOR for road project starting in July, Hwy 34/75 project, South of Murray through Plattsmouth. 
CLERK REPORT – The clerk did a rate comparison for NeRWA, submitted letters and paperwork on Lead/Copper testing results.  Gathered facts and reports for June 1 dog bite incident.  Working on possible emergency funding for urgent Well Pump Replacement project costing $15,000.

Village Maintenance Report - Steve Heyen was present to report that the back up well pump pumped 2,178,000 gallons of water.  Lift station processed 1,296,000 gallons of wastewater.  There is a large leak at 209 A. St. that is being repaired from the curb stop to house main. Heyen reported that hot water install is finished in concessions stand and rest rooms. He is still working on stool repair in South restroom. Farmer’s well covering still needs to be replaced.  The village is still running on back up well pump. Layne Christensen Co. ordered a new 10hp pump and control box to install for Friday June, 11.  The estimated cost of the project is $15,000.  Dave Schmidt reported a missing curb stop cover for his place and that the sidewalk has sunk, leaving the curb stop above the concrete.
Fire Report- NTR
Union United Inc. Report:  New street planters were planted and distributed on Main St.  Two more were purchased to put on caboose deck, but not planted yet.  Mural design has been approved. Money that was to defray the cost of the un-budgeted deck rebuild has been used for the mural down payment, leaving the street banners and planting projects without funding to be finished.  If the Village would like the banners to be purchased, Hansen suggested the Board could approve some of the Street Funds to pay for the banners, estimated $800 - $1000.
The next fundraising opportunity for Union United is the Annual Golf Tournament, scheduled for August 14, 2021.

NEW BUSINESS: Heather Cook shared her witness account of the Martinez’s terrier biting a child in Todd Park.  She said the dog was running at large and approached the kids playing in the park.  The dog seemed to be okay with their attention, until it bit the victim.  Cook also said, during the bite, the dog, which she was very familiar with, seemed unlike himself.  She also shared that the Martinez’s terrier bites and is toothy with his owner’s children, but doesn’t draw blood and that the owners don’t seem to discourage this type of rough play.  Cook also said that the Martinez’s terrier is frequently running at large and she has had to bring him home many times.  The clerk shared that she has not been contacted to register the dog within the Village and does not have vaccination records on file.  The Board discussed the dog’s history.  Heyen stated that the terrier is very aggressive when he approaches the house to take the meter reading and when he is mowing the park. The Board discussed the terrier’s proximity to the public park and the liability involved if the terrier were to escape the yard and bite another child at the park.  They came to the conclusion that the responsible thing to do is to declare the dog as a nuisance and ban the dog from the Village, as a potentially dangerous dog, given its propensity to escape his enclosure, aggressive behavior and its proximity to the playground.  Crook motioned to pass Resolution 21-1.  2nd by Ruby.  By Roll, Trustee votes are as follows:  Seyler – Aye, Vidlak – Aye, Crook – Aye, Ruby – Aye, Hill - Aye. Motion approved.

Ruby motioned to approve the consumption of alcohol during the adult softball league games on execution of the facilities use agreement.  2nd by Crook.  By Roll, Trustee votes are as follows:  Seyler – Aye, Vidlak – Aye, Crook – Aye, Ruby – Aye, Hill - Aye. Motion approved.

Vidlak motioned to approve the Frontier Coop prepaid propane contract for 2021 of 1600 gallons, at $1.39 per gallon, in the amount of $2224.00.  2nd by Ruby. By Roll, Trustee votes are as follows:  Seyler – Aye, Vidlak – Aye, Crook – Aye, Ruby – Aye, Hill - Aye. Motion approved.

The next regular meeting is scheduled for July 14, 2021, 7 pm at the Union Fire Hall.  The Meeting Notice and Agenda will be posted for the public at the Village Office, the Union Junktion, and the Union Post Office by July 9th.
